LHAgenda.com (the “Site”) is owned and operated by LH Agenda PTY LTD (ABN 88 612 043 802). (“LH Agenda”, “the Owner”, “we”, “us” or “our”). We make this Site and the content, information, products and services available on this Site (collectively the ” Service”) subject to acceptance of and compliance with the terms and conditions set forth in these terms of use (collectively, the “Terms of Use”) and elsewhere on this Site. The terms “you,” “your” “yours” and “yourself” refer to all visitors to this Site.

By using or visiting this Site you agree to be bound by these Terms of Use and to use the Site in accordance with these Terms of Use, our Privacy Policy, and any additional guidelines, rules, terms and conditions that may apply to specific sections of the Site or to the Service available on the Site or to anything else referenced herein. The Website is available for you to access, conditional on your acceptance without limitation or alteration of the terms and conditions set out below.

Certain features and functionality included in the Service may be subject to additional posted notices, terms and/or conditions. Your use of such features and functionality is subject to those additional notices, terms and/or conditions, which are incorporated into these Terms of Use by reference. In the event of an inconsistency between these Terms of Use and any additional posted notices, terms and conditions, these Terms of Use shall control.

Except as otherwise expressly stated on this Website and to the full extent permitted by law, this Site and all information contained within it regarding or relating to the Owner, products and services is provided “as is” and on an “as available” basis without any representation or endorsement made and without warranty of any kind, whether expressed or implied.

We reserve the right to change these Terms of Use or to impose new conditions on use of the Site or the Service, from time to time, in which case we will post the revised Terms of Use on this Site and they will be effective immediately upon posting. By continuing to use the Site after we post any such changes, you accept the Terms of Use, as modified. If you do not agree to any change, then you must immediately stop using the Sites.

You should read the Terms before placing an order online and check back often for any changes. Any changes made after you have placed an order will not affect that order, unless we are required to make the change by law.

We do not promise to continue to offer or maintain the Sites. We may, at any time and without prior notice to you, withdraw the Sites from use and terminate any or all of the rights granted by the Terms.

Applicable Law

The Terms are governed by the laws of NSW, Australia. You agree to submit to the exclusive jurisdiction of the courts exercising jurisdiction in NSW, Australia.

Placing and Acceptance of your order

When you place an order or make a booking via our site, you make an offer to purchase the selected goods or services from us in accordance with these Terms. Unless you cancel your, your offer is accepted, and the contract for the supply of the goods or services completed, when an email is sent from us (or our authorised agent) confirming that the goods have been dispatched and handed over to the designated carrier.

We may use your personal information (e.g. your personal and payment details) for the purpose of performing credit checks. Where necessary, we may transmit or obtain information or updated information about you (including your card number) to or from third parties for the purposes of authenticating your identity, validating your card, obtaining an initial credit card authorisation and / or authorising individual purchase transactions.

Please refer to our Privacy Policy for further information about how we use your personal information.

PRICES

Prices are inclusive of GST when applicable and are displayed in:

Australian Dollars (AUD, AU$) on our Australian Sites; and
US Dollars (USD, US$) on our International Sites.

Prices are subject to change, effective immediately upon posting to the Site(s) or other form of notification.

International Taxes

Please note some countries charge local customs fees or VAT for orders arriving from overseas.

LH Agenda does not accept any responsibility for customs delays, duties or taxes that may apply in destination country.

LH Agenda recommends international customers to contact their local Customs Office in regard to any potential duty you may be liable for. By confirming a purchase you are accepting responsibility for all customs charges incurred as LH Agenda will not refund customers who incur any such charges.

PLEASE NOTE: To comply with Australian export regulations we are required to declare the exact value of all items ordered and to mark them as dutiable ‘merchandise’. We are prohibited by law from marking the order as a ‘gift’, even if the order is placed with the intention of sending to a gift recipient.

Transit Insurance

Transit insurance covers you for lost, stolen or damaged in transit deliveries and we highly recommend it for peace of mind. If your parcel is deemed lost, stolen or damaged in transit we will resend a new order to you promptly. We will resend your parcel only once.

If you did not select the transit insurance option during checkout, we cannot take responsibility for any damaged or missing deliveries.

Transit insurance doesn’t cover:

Delays by a third-party such as postal service or customs
Returned or misdelivered parcels due to an incorrectly provided address at checkout, or because the customer did not respond to the courier message in a timely manner or refused to pay import taxes levied by their country, or did not pay import taxes within the timeframe imposed by customs.

INTENDED USE

By placing an order, you agree to use the products or services only for their intended purpose. If you use the products or services for any other purpose, you will assume full responsibility for any loss or damage arising out of such use.

Shipping and Delivery

We ship to 47 international destinations including USA, Canada, New Zealand, some European and Asian countries.

Once orders are placed, they are not able to be edited, added to or cancelled.

DISPATCH TIMES

All orders are processed typically within 1-3 business days.

DELIVERY TIMES

We offer both express and standard shipping.

The most up-to-date delivery times are listed on the FAQ page and estimated from the time of posting in Australia to delivery in metro locations in the destination country. They don’t include time spent in customs, which is out of our control. All quoted delivery times are approximate only and subject to change.

Please note: You may experience slightly longer delivery times during peak periods, due to wild weather, or due to other postal service delivery issues that are unforeseen or unavoidable events beyond Our reasonable control. LH Agenda cannot be held responsible for delays by postal service or customs.

All orders are processed and shipped from Newcastle, NSW and so we follow any NSW Public Holidays.

Tracking & Receiving your order

All our customers receive notifications of order confirmation when the order is paid and tracking number when the order is shipped. If you haven’t received it please check your junk email. Please search for “LH Agenda”. If you cannot find it, please email us and we will resend it then.

Please note you cannot receive your tracking number unless your order has been shipped. For that reason you will receive a tracking number not earlier than 1-6 days after your order has been placed. If your order includes items on pre-order, your entire order will only be shipped once pre-order items become available.

Authority to leave

If authority to leave has been given and the courier tracking dashboard says it has been delivered we cannot take responsibility for the delivery.

Digital products

Digital products are sent immediately after the order is made and paid. After the payment has been processed you will receive an email with a link to the downloadable file(s). If it’s been more than 10 minutes and you still haven’t received an order confirmation, please check your junk/spam folder, and the Promotions tab in Gmail. You can also search for an email containing the title “Your LH Agenda order”. If you still can’t find it please contact us directly and we will resend the order confirmation. If you purchased both physical and digital products in one order, you will receive an ‘order completed’ confirmation once we pack and ship the physical products, which is done every Monday.

For those with Hotmail accounts, please note that the service has many issues as it is no longer supported by Microsoft. Unfortunately, there isn’t much we can do for email delivery issues to Hotmail addresses and you may experience delays in receiving your order. If you have already placed your order, contact us and we will find a way to send the products to you.

LOVE IT GUARANTEE Promise, Returns and Refunds

We are confident you will love our products! So if you are unhappy with them for some reason, you can return your order for a full refund (including shipping costs you paid when you purchased the item) within 60 days from the purchase date. The offer to refund the outbound shipping costs refers to economy shipping option only.

There are some fair limitations to our Love it Guarantee promise.

Our Love It Guarantee is designed to allow our online customers to see and touch our products, similar to a physical store, without taking any risks. It is also to protect our customers against manufacturing defects. To qualify for the guarantee, the product must be unused and in their original packaging, in a shipping-appropriate cardboard box to ensure it arrives at our studio in mint condition.

Note that it is your responsibility to read the product description carefully to ensure you are aware of what you are purchasing. Unless your product arrived damaged or has manufacturing defects, it is your responsibility to pay for the return shipping. We will, however, refund you in full once the item has been returned in mint condition – including the outbound shipping fee you paid when you purchased the item. We may also ask you to answer some questions to help us improve your products in the future. The offer to refund the outbound shipping costs refers to standard shipping option only.

In the rare case where your item arrived damaged, or has manufacturing defects, we are extremely sorry! Please email us photos of your purchase so we can share these with our factory or courier to further improve our services. We will work together with you to resolve this issue.

The following items cannot be returned or exchanged

Because of the nature of these items, unless they arrive damaged or defective, we can’t accept returns for:

Custom or personalised orders
Digital downloads
Sale items
Used products
Dated planners

We encourage you to read the product description carefully and check the images on our website before ordering.

We cannot process refunds for items that:

Are delayed by a third-party such as postal service or customs
Are returned or lost due to an incorrect address, or because the customer did not respond to the courier message in a timely manner
Are returned because the customer refuses to pay import taxes levied by their country
Are returned damaged for any reason, such as parcels that aren’t packed correctly for return shipping, or are mishandled by the courier company

We will offer a refund:

When you return the item within 60 days from the purchase date following Love Me Guarantee promise terms
When the item you received is significantly different from the product description
When your item needs to be replaced due to manufacturing defect but we sold out of the exact item you purchased
Express shipping – we will refund the Express Shipping fee if we fail to ship within 3 business days or if we accidentally ship your order with a standard post. However, LH Agenda cannot be held responsible for delays caused by a postal service or customs. All delivery times quoted are approximate only. We do not receive any compensation from Australia Post when a parcel misses the estimated delivery window and therefore we won’t be able to offer a refund. Please contact your local postal service if you would like to make a complaint regarding shipping times.

We will offer a replacement and reship a new item to you:

If we shipped the wrong item
If an item has a manufacturing defect
When your parcel was damaged or lost in transit and you purchased transit insurance at checkout.

Refunds outside Love It Guarantee.

We understand that from time to time, mistakes are made. If you need your order amended or cancelled prior to shipping, or partially refunded, we are more than happy to assist you. However, we will deduct a non-refundable 3.5% credit card fee and a $5 admin fee from your refund.

Resolution time

Please note all delivery issues and returns have to be initiated within 60 days from the purchase date. We take no responsibility for missing deliveries or returns if you contact us after 60 days from the purchase date.

Offers

All terms of an offer must be met.

Offers are valid only for the period specified and will end at 11:59am AEST on the end date, unless stated otherwise in the offer terms. Offers are not valid on purchases made before, or after the promotional period.

Items on sale during an LH Agenda pre-sale offer will be subject to an order quantity limit per customer, per order, which we may determine or amend (in our absolute discretion) at any time.

Please note offer periods are subject to product availability and will terminate early if stocks run out.

We reserve the right to vary, withdraw or cancel offers for any reason at any time.

Promotional Codes

Sometimes we offer Promotional Codes which may apply to any, or certain specified purchases or products on this Site.

Each Promotional Code will be subject to specific terms & conditions specified at the time the Promo Code is issued (including the length of time to use the code) in addition to those mentioned in these Terms of Use.

Only one Promotional Code can be used against an order at any one time unless otherwise stated within that codes specific Terms and Conditions.

A Promotional Code can’t be applied to an order after that order has been placed.

If any exclusions apply to that Promotional Code, it will be outlined within the relevant codes specific Terms and Conditions.

If the Promotional Code has expired, you won’t be able use it.

We can’t accept any responsibility once we have given you a Promotional Code and we are not obliged to provide you with a replacement if it gets lost and/or gets used by someone else as this will result in the Promotional Code being cancelled.

If a Promotional Code is offered on this Website and can’t run properly because of fraud, tampering, technical errors or anything else that is beyond our control which affects the running, administration, security or fairness of the Promotional Code, we reserve the right to cancel, modify or suspend the Promotional Code.

Promotional Codes are non-transferable and cannot be exchanged for cash. If you receive a Promotional Code, it can only be used by you for the purpose for which it was issued.

Don’t pass your code directly on to others or make it available to others (for example, posting it on social media). If we believe that at the point of purchase or retrospectively you are abusing the use of Promotional Codes in any way, we reserve the right to cancel your Promotional Code or suspend/close your account without letting you know beforehand.

When returning an item purchased with a voucher/promo code, your refund or exchange value will be equal to the final discounted price that you paid for the item and will be honoured only in compliance with our regular refund and exchange policy.

Prizes, Gifts, Giveaway (Sweepstakes) and other Promotions

From time to time LH Agenda PTY LTD offers contests, sample giveaways and other promotional activities (a “Promotion”). Your registration and/or enrolment for, and subsequent participation in, any Promotion shall be subject to rules and regulations associated with such Promotion which will be posted on the Site. You may be automatically enrolled and/or registered for certain of these Promotions by participating in the interactive features of our Site, such as by submitting product reviews or submitting other content postings, or by other actions, such as by registering for Site emails or referring new users to the Site. Unless otherwise specified by the rules and regulations of a particular Promotion, the Promotions require that participants be eighteen (18) years of age at the time of entry and that participants have a residential address in Australia.

Subject to any specific terms or conditions that are displayed with any prizes, gifts and giveaways at the time they are offered, displayed or advertised, when prizes, gifts or giveaway items or the like are offered, displayed or advertised on our Website, to full extent permitted by law:

– may withdraw the offer of the prize/s at any time prior to the time the recipient/s of the prize are to be drawn or otherwise determined, without notice to you, in the event that we are, for any reason, unable to supply the prize/s; and

– will not be liable under any circumstances for any loss of profits or any damages of any kind recognised by law (even if it has been advised of the possibility of such loss of profits or damages) as consequence of the withdrawal of the prize/s;

– in the event that we are unable to supply the exact gift/s and/or giveaway item/s displayed to you for any reason, may supply in it/their place an alternative items/s of a similar nature and value; and

supply of the alternative item/s will be in complete satisfaction of the Owners obligation to the recipient/s in respect of the gift/s and/or giveaway items/s, to the extent permitted by law; and

– The notification of the award is made by email. In the event that the winner doesn’t respond to the Owner’s notification about the prize award the Owner will repeat the attempt to notify the winner 3 days after the first notification. If this is not successful alternative winner will be chosen not earlier than in seven days from the first notification.

The free product samples and freebie offers from or listed through the site are provided “as-is,” “as available,” and all sample product warranties, express, statutory or implied, are disclaimed by LH Agenda PTY LTD, including but not limited to, the disclaimer of any implied warranties of title, non-infringement, merchantability, quality and fitness for a particular purpose. By receiving any products through such sample and freebie offers, you agree to release and hold harmless LH Agenda PTY LTD and affiliates, and each of their respective parent companies and each such company’s officers, directors, shareholders, employees and agents from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in any product samples and freebie offers or receipt or use or misuse of any such product.

Restrictions

You may not use the Site if you are under thirteen (13) years of age. By using the Site and/or the Service, you represent and warrant that you have the right, authority and capacity to enter into these Terms of Use and to abide by all of the terms and conditions set forth herein. This Site is administered in Australia. The Owner is an Australian business. The pages on this Website contain information about products and services available in Australia and generally in other countries. Consumers are advised to check the individual product or service to determine its availability where you reside. The prizes, gifts, giveaways and services are offered to consumers in Australia unless otherwise stated and nowhere else. Any use outside of Australia is at your own risk and you are responsible for compliance with any local laws applicable to your use of the Site or the Service.

You may not modify or copy any portion of the Site and/or Service without the LH Agenda PTY LTD’s express written permission. Information about requesting permission to reproduce or distribute materials from the Site may be obtained by contacting us.

You agree that you shall not (and you agree not to allow any third party to):

modify, adapt, translate, reproduce or distribute any portion of the Site and/or Service.
resell, redistribute, reproduce and store in any storage media any portion of the Site.

Content Posted By You on the Site

In order to access or use certain features of the Site such as competitions or giveaways or receive Newsletters you may be required to register with us on a registration form which will require you to provide personally identifiable information (such as your name, age and an e-mail address you own) and to select a password and user name (“User ID”) and screen name. You may not use the Site to make offers or disseminate any fraudulent goods, services, schemes, or promotions, including any make-money-fast schemes, chain letters, or pyramid (ponzi) schemes.
You may not affect the way LHAgenda.com displays its pages, such as by framing LHAgenda.com or placing pop-up windows over its pages.
You may not customise LHAgenda.com in a way that adversely affects the display of any advertising or promotional links on the site.
You may not modify or create variant versions of LHAgenda.com ‘s logos or other trademarks.
You may not gather for marketing purposes any e-mail addresses, user names, passwords or other personal information that has been posted by other users of the Site.

LH Agenda PTY LTD reserves the right to investigate and take appropriate legal action in its sole discretion against anyone who violates these rules, including without limitation, removing the offending Posted Content or other Content from the Service. We have the right to take any of the following actions in our sole discretion at any time and for any reason without giving you any prior notice:

Reject, move, or remove any material that you submit to our sites for any reason
Reject, move, or remove any content that is available on our site
